Failure to Diagnose, Wrongful death
Representing the surviving family of a teenage girl who died after her complaints of chest and breathing pain were not properly diagnosed by her doctor. She died of a pulmonary embolism which could have been detected by a CAT scan, a diagnostic procedure that her father begged the doctor to perform but the doctor rejected.
Verdict: $395,000
Surgical Error, Medical Malpractice
Our client was told by her doctor that she needed her gall bladder removed. During the operation, the surgeon cut the common bile duct instead of the cystic duct. The error caused a major obstruction of the common bile duct and a painful bile accumulation in our client’s abdomen. When the surgeon learned of his error, he personally drove our client to a different hospital, the emergency room of Los Angeles County-USC Medical Center, leaving her there without any medical records. She underwent major reconstructive surgery at USC and required an extensive recuperative period. The jury found the surgeon guilty of malpractice and awarded our client $395,000.
Settlement: $175,000
Surgical Error
During a laparoscopic procedure, the medical team’s negligence caused a heavily overweight woman to slide off the operating table onto the floor and sustain serious internal cuts and bleeding from the unrestrained surgical instruments in her body. We held the healthcare providers liable and reached a $175,000 settlement for our client.
Settlement: $125,000
Surgical Error, Defective Medical Material
Despite the recall of a defective medical webbing, the surgeon and hospital used it on our client. This serous error, and the ensuing uncertainty of her medical condition, caused our client major psychological harm. We were able to reach a settlement with the doctors and hospital for our injured client.
