Aviation - Helicopter Midair Collision
Severe Orthopedic Injuries
Our client, a 22 year old Marine and Iraqi war veteran was on a pilot-training exercise at Torrance Municipal Airport when his Robinson helicopter collided midair with another helicopter, killing the two people aboard the other aircraft. In the crash, the young man broke every bone in his body from the waist down, was in a coma for three weeks and suffered compartment syndrome which required him to have open wounds for an extended time. Nearly every bone in his lower body needed orthopedic instrument repair. In our relentless investigation into the cause of the accident, we challenged NTSB and FAA findings blaming the pilots and conducted independent detailed crash analysis. The judge in the bench trial ruled the air traffic controllers negligent and entirely responsible for the injuries and loss of lives. Our client received a $4.5 million damage award.

Construction Accident, Lower Back Disc Injury and Post Traumatic Stress Disorder
A 53-year-old cement mason was injured in the collapse of a 4-million gallon digester tank in the middle of a construction site. Our client managed to escape the collapse but was injured in the process. He had an extensive medical history of multiple trauma-related injuries, including to the lower back, where he had had surgery prior to the construction accident. The defense insurance company's highest offer in settlement was $15,000. A jury awarded our client $3.3 Million.

A 22-year-old UCLA student was walking in a marked crosswalk when she was struck by a car driven by a Mexican movie star. The impact threw our client 25-feet. She sustained a brain injury and a fracture of her knee. Our client obtained a verdict at trial of $2.9 Million.

Our client's 30-year-old husband was killed when an alignment rack fell off of a trailer during delivery. The rack landed on the man's head, killing him instantly. We filed suit against the trucking company for the improper unloading of the rack. We also demonstrated that the company had prior delivery problems. The trucking company paid $2.5 Million to settle the case.

Our clients' son, an 18-year-old college student, was stranded on the freeway when his car spun out in the rain and stalled in one of the lanes of traffic. While our clients' son waited in his car for assistance, his car was struck from behind by the driver of a truck. The truck penetrated the passenger compartment of the car. The young man was killed on impact. The case settled for $2 Million.

Traumatic Brain Injury (TBI)
A 78-year-old golfer was leaving the green on the 5th hole at Penmar Golf Course, where he was playing, when he was struck on the head by the ball from a golfer who teed off on the 5th tee. We filed suit against the golfer who hit our client and against the City of Los Angeles, the owner and operator of the course. The City was held accountable by the court because it had failed to put in safety measures that were called for by the City's own designs for the course. The jury returned a verdict of $1.18 Million.

While stopped in traffic on the 5-Freeway in Castaic, our client was rear-ended by another car. The impact caused our client's seat to break and made him strike his head on the door. He sustained a neck injury that required surgical repair. The case settled for $1 Million.

While our client was a passenger on an airport bus in San Francisco, the driver lost control of the bus on the freeway. The bus hit a concrete bridge pillar. Our client was badly injured and two fingers on one of her hands had to be amputated. Even though the bus company had limited insurance, the company agreed to contribute additional money to what its insurance company was offering. The case settled for $990,000.

Serious Personal Injury, Severe Leg Fracture with Pain Syndrome
A courier was making a delivery of heavy rolls of aluminum. At his destination, an employee of the receiving company tried to unload the shipment with a pallet jack. The employee lost control of the pallet jack. It caught our client's foot as he tried to jump off the truck. Our client's leg was severely fractured, resulting in chronic regional pain syndrome. We sued the company that originally loaded the shipment in such a way that a forklift couldn't be used to unload it. We also sued the company that unloaded the shipment. After numerous depositions of witnesses and experts, the case settled a few days before trial for $700,000.

An 18-year-old male was a passenger in a car driven by a high school friend. Due to erratic driving, the vehicle careened off the road and rolled down an embankment. In addition to receiving extensive sprains and strains in the accident, our client suffered post traumatic stress, leading to a three day hospitalization in a psychiatric unit. A few days before trial, the case was settled for $700,000

Our client was a police officer employed by a railroad. While on duty, our client pulled his police car to the side of the road in order to inspect an overpass for thieves. After unbuckling his seatbelt in preparation for exiting his car, his car was rear-ended by a driver who had fallen asleep at the wheel. The impact threw our client up into the gun rack positioned above his head, resulting in our client suffering a brain injury. We filed suit against the railroad under the Federal Employers Liability Act (FELA) based upon the improper positioning of the gun rack. The case settled for $600,000.

A caddie was hit in the back of the leg by a golf cart, driven by a golfer. The incident caused an aggravation of a pre-existing arthritis in the knee, leading to knee replacement surgery. A week before trial, the driver's insurance company settled the case for $600,000.

An elderly retiree's apartment flooded as a result of a water main breaking in an upstairs apartment. Even after the damage to the woman's apartment was cleaned, our client acquired a respiratory infection from the mold infestation that ensued. The respiratory infection led to violent bouts of coughing, which caused several fractures of ribs and vertebrae due to our client's advanced osteoporotic disease. We recovered $500,000 in damages from the homeowner of the upstairs unit and the plumbing company that was servicing the water main.

A 73-year-old retired teacher was injured when she tripped over an unmarked step in a doorway of a private library on the premises of the Huntington Library, Art Gallery & Botanical Gardens in Pasadena. She fractured her right shoulder, which required surgical repair. Our client had an extensive medical history, including prior right shoulder problems. The Huntington's insurance company claimed that the accident was caused solely as a result of our client's inattention and that she was exaggerating her injuries. The defendant's insurance company did not offer any money in settlement prior to or during trial. A jury returned a verdict in the amount of $450,000.

A surgeon stepped in unmarked wet cement on the floor of a hospital. He severely injured his ankle, keeping him out of work for an extended period of time. The hospital and flooring company that was installing the new floor settled for $425,000.

A 38-year-old attorney was injured when a bus that she was riding in side-swiped a car. As a result of the accident, our client fell off the seat onto the floor and later developed fibromyalgia, a pain disorder that affects many parts of the body. Surgical Error, Medical Malpractice
Our client was told by her doctor that she needed her gall bladder removed. During the operation, the surgeon cut the common bile duct instead of the cystic duct. The error caused a major obstruction of the common bile duct and a painful bile accumulation in our client’s abdomen. When the surgeon learned of his error, he personally drove our client to a different hospital, the emergency room of Los Angeles County-USC Medical Center, leaving her there without any medical records. She underwent major reconstructive surgery at USC and required an extensive recuperative period. The jury found the surgeon guilty of malpractice and awarded our client $395,000.

Railroad Accident/FELA, Neck Injury/FELA
A railroad employee injured the discs in his neck from the violent movement of a train. The employee was stepping from one car to another when he was thrown against the train due to a defective connection between cars. We filed suit under FELA and recovered $300,000 for our client.

Our client was a grip for a studio. While unloading a movie set's walls from a trailer, the driver of the trailer improperly untied them. The walls cascaded down, crashing onto our client's foot. He suffered a crushed foot, which resulted in chronic regional pain syndrome. The case settled several days before trial for $325,000.

While walking his dogs on a public street, two large Tibetan Mastiffs, being walked without their leash, charged our client's dogs. In the scuffle, the Mastiffs knocked our client to the ground, causing a torn rotator cuff. The Mastiff owner's insurance company settled the case for $250,000.
